What is Import Export Code (IEC Code)?

The Import Export Code (IEC) is a 10-digit code issued by the Directorate General of Foreign Trade (DGFT) under the Ministry of Commerce, India, required for individuals or businesses involved in international trade. It serves as a unique identification for customs clearance, shipping, and access to government benefits. To obtain an IEC, an application with necessary documents must be submitted to the DGFT. Once issued, the IEC is valid for life unless surrendered or revoked.

When will there be requirement of IE code?

At following instances the IE Code would be required:

  • When an importer has to clear his shipments from the customs then it’s needed by the customs authorities.
  • When an importer sends money abroad through banks then it’s needed by the bank.
  • When an exporter has to send his shipments then it’s needed by the customs port.
  • When an exporter receives money in foreign currency directly into his bank account then submission of IEC is required by the bank.

Who needs an IEC code?

Any individual or business entity who wants to engage in import or export of goods and services from India must obtain an Import Export Code (IEC) from the Directorate General of Foreign Trade (DGFT) or its regional offices. It includes:

  • Businesses: All types of businesses, including sole proprietors, partnerships, limited liability companies (LLPs), private limited companies, public limited companies and any other form of import/export entity must obtain an IEC code.
  • Manufacturers: Manufacturers who wish to export their products to foreign markets or import raw materials and components for manufacturing purposes require an IEC code.
  • Traders: Traders who buy and sell goods internationally need an IEC code for customs clearance and compliance purposes.
  • Service Providers: Service providers who provide services to clients outside India and accept payments in foreign currency also need to obtain an IEC code.
  • Individuals: Individuals carrying out international business activities in their own name, such as importing goods for personal use or exporting products in the course of a commercial enterprise, must obtain an IEC code.

What are the documents required for IEC code?

The specific documents required to obtain an Import Export Code (IEC) may vary slightly depending on the regulations of the country issuing the code. However, here is a general list of documents commonly required for Import export code registration (IEC code registration):

Types of businesses eligible to obtain an Import Export Code

In general, different types of business entities are eligible to obtain an Import Export Code (IEC) in order to engage in international business activities. Here are the common types of businesses eligible for an IEC code:

  1. Sole Proprietorship: A sole proprietorship is a business owned and operated by one person. Sole proprietors are eligible to apply for an IEC code to facilitate import and export transactions for their business.
  2. Partnership Firm: Partnership firms, where two or more individuals join together to carry on business for profit, can collectively apply for the IEC Code. The partners jointly own and manage the business and are jointly liable for its obligations.
  3. Limited Liability Partnership (LLP): LLPs are hybrid business entities that combine the features of a partnership and a corporation. LLPs are separate legal entities distinct from their partners and can apply for an IEC code to engage in international business activities.
  4. Limited Liability Company: A limited liability company is a type of business entity that limits the liability of its shareholders and has a separate legal existence separate from its owners. Limited companies are eligible to obtain an IEC code for import and export purposes.
  5. Joint stock company: Joint stock companies are companies whose shares are publicly traded on a stock exchange. Like private limited companies, joint stock companies can apply for an IEC code to facilitate their import and export transactions.
  6. One Person Company (OPC): An OPC is a type of private company with a single shareholder as the owner. OPCs have limited liability and can obtain an IEC code to engage in international business activities.
  7. Registered Trusts: Trusts registered under the relevant Trusts Act are eligible to apply for an IEC code if they are engaged in import and export.
  8. Registered Companies: Companies registered under the relevant Companies Registration Act may also be eligible to obtain an IEC code for engaging in international trade depending on the country’s regulations.

 Eligibility criteria to Get IEC Code 

  • Business Entity: Individuals, partnerships, LLPs (Limited Liability Partnerships), trusts, companies and any other legal entity engaged in importing or exporting can apply for an IEC.
  • Legal person: The applicant must be a legally recognized person under the laws of the country. For example, in India, this includes entities registered under the Companies Act, 2013, the Limited Liability Partnership Act, 2008, the Partnership Act, 1932, etc.
  • Income Tax PAN: Applicant must have a valid Income Tax Permanent Account Number (PAN) issued by the relevant tax authority. This applies to both natural-person and business entities.
  • No Criminal Record: The applicant must not have been convicted of any criminal offense related to foreign trade or economic offenses.
  • Not on the Denied Entity List: The applicant or any of its partners/directors should not be on the Denied Entity List maintained by the Government or any regulatory authority.
  • No Export/Import Restrictions: The applicant should not be subject to any export or import restrictions imposed by the government or any regulatory authority.
  • Compliance with foreign exchange regulations: The applicant must comply with the foreign exchange regulations of the country, including regulations regarding foreign currency transactions, foreign investment and repatriation of funds.
  • Compliance with Export Control Laws: The applicant must comply with export control laws and regulations, including restrictions on the export of certain goods, technologies or services.

How to register import export code online?

  • Is PAN Number or PAN card essential or what are the alternatives?

    Yes, PAN is mandatory. Self-Certified Photocopy of PAN card of the Applicant has to be submitted along with the application.

  • How much time does it take to get an IEC?

    All applications will be processed and disposed within 5-6 working days of their receipt.

  • What is RBIs Automatic approval or Specific permission when there is Non-Resident Interest Foreign Investment in the firm for obtaining IEC?

    • Notification No. 20/2000/RBI dated. 3rd May 2000. Applicants are also required to furnish
    i. Copy of Money invested report filed before the Regional Office of RBI.
    ii. Copy of Report filed in Form FC-GPR, Part A for the issuance of shares to Regional Office of the Reserve Bank of India.
    iii. If specific permission has been granted by RBI regarding Non-Resident Interest, then copy of that permission to be furnished with Application form ANF-2A.

  • Can a Public Limited Co. or Private Limited Co. or Partnership obtain different IECs for different concerns owned by it?

    No. However the name of each concern owned by such a company may be included in the IEC of the firm in whose name PAN exists, as a branch.

  • What are the documents required for issue of Duplicate IEC?

    Duly filled application form along with application fee of Rs.200/ and
    an affidavit on stamp paper of Rs.100/- duly notarized.

  • Can IEC be hand delivered or over the counter?

    No, IEC issued are not dispatched or delivered. IEC will be issued in digital format. The applicant has to take an IEC print out of the digitally signed IEC.
